The aim of these General Terms of Sale and Use (hereinafter the "Terms" or "TOS") is to define the terms and conditions for acquiring products sold on the https://www.stadefrance.com/fr website (hereinafter "the Website").

Said Website is published by CONSORTIUM STADE DE FRANCE (hereinafter "STADE DE FRANCE").

By accessing the Website and purchasing the products sold thereon, the Business, Group or Works Council customer (hereinafter "the CE User") accepts and agrees to comply with and ensure compliance with these Terms.

Purchase implies full acceptance of these Terms.

All orders imply acceptance of the prices and the description of the products available for sale.

STADE DE FRANCE reserves the right at any time to adapt or amend its Terms. In the event of an amendment, the Terms of Sale and Use in force at the time of the order shall be applied to said order. Therefore, the CE User shall consult the TOS on a regular basis in order to keep informed of the most recent changes.

ARTICLE 1 - PRESENTATION OF THE WEBSITE

"stadefrance.com" is an information and commercial website that offers the following non-exhaustive list of products and services for sale: tickets, visits, merchandising products, car park access tickets and so forth.

ARTICLE 2 - ACCESS TO THE WEBSITE

To make maximum use of the Website, users and in particular the CE User should get a high-speed Internet connection.

Users and especially the CE User undertake to comply with and ensure compliance with these Terms, the General Terms of Use of the Website available on the Website and all the Laws and Regulations in force.

ARTICLE 3 – REGISTRATION ON THE WEBSITE

3.1 PROCEDURES

Any Internet user can access the Website and its various sections.

However, users must create a personal account in the "Pros, Groupes & CE" (Businesses, Groups and Work Councils) section to be able to purchase tickets and receive the Stade de France newsletter dedicated to Businesses, Groups & Works Councils.

In order to register in the "Pros, Groupes & CE" category, the CE User goes to the Website, clicks on "Pros, Groupes & CE", then clicks, in the top right hand corner, on "Créer un compte" (create an account), fills in the relevant fields (identity of the Business, Group or Works Council, password (which must be confirmed), email, etc.) and then validates.

As a professional, the CE User declares that it is not a natural person customer and accordingly is not acquiring or using the products and services sold on the Website for personal or family needs.

If STADE DE FRANCE does not validate the profile, the user does not receive the "structure id" and can therefore not connect to the Website.

If STADE DE FRANCE validates the profile, the user receives an email with its "structure id".

From then on, the user can connect to and purchase products from the Website at the CE rate as specified herein.

The CE User is informed that it is solely responsible for keeping its account and password confidential and it agrees to immediately inform STADE DE FRANCE of any unauthorised use of its account and/or password and/or breach of security.

Registration on the Website implies full acceptance of these Terms by the user.

3.2 CONDITIONS OF REGISTRATION ON THE WEBSITE AS A CE USER

Unless prior written approval has been obtained, only the local-government subsidised Works Councils (social clubs, social work committees (COS), social action committees (CAS)), the Works Councils and associations may qualify as a CE User and gain access to this sale service.

Travel agencies, coach operators or tour operators may also qualify as a CE User if their end customer is a Works Council, a local authority or an association subject to specific sale conditions dictated by an organiser.

In any case, the CE User undertakes to only issue tickets and other products purchased on the Website to the employees of the company or other members of the association wishing to personally acquire tickets and/or products for an event organised at the Stade de France.

The CE User shall ensure that any transferee has full knowledge of these General Terms and the organiser’s General Terms of Sale/Purchase and Use of the tickets/access passes and that said transferee accepts to comply therewith.

The CE User shall act as guarantor for compliance by said transferee of said ticket(s) with these General Terms and with the organiser's General Terms of Sale/Purchase and Use of the tickets.

Special terms of sale apply to any other type of customer depending on the events and depending on the agreements existing between the organisers and the STADE DE FRANCE CE Sales Department.

ARTICLE 4 – PRODUCTS ON SALE ON THE WEBSITE - "BUSINESS, GROUPS AND WORKS COUNCIL" SPACE

A minimum purchase of 10 (ten) tickets per event, all categories combined, is required per order to benefit from the "Business, Groups & CE" rates for each relevant event.

Likewise, in order to benefit from a "Business, Groups & CE" rate for a visit, a minimum purchase of 10 (ten) tickets for the same visit is required per order.

Subject to this limitation, all products on sale on the Website may be purchased separately within the limit of the quantity stipulated on the Website and all things considered while stocks last.

The key features, in particular the nature, the substantial qualities or the composition of the products, are described on the Website.

Unless otherwise specified in writing, the prices stated on the Website shall be understood as in Euros inclusive of all taxes. They take into account the applicable VAT on the day of the order. Any change in the VAT rate may be reflected in the prices of the products.

Prices may not be changed once the CE User has placed the order. The prices of the products ordered on the Website and the date of the order in question shall prevail.

ARTICLE 5 – PURCHASE OF TICKETS AND CATERING SERVICES

5.1 RECREATIONAL AND FOOD PRODUCTS PROPOSED FOR SALE ON THE WEBSITE

 

The Website proposes the sale of the following products:

  • tickets to events at the Stade de France
  • access passes for the Stade de France car parks for events taking place therein
  • tickets for visits to the Stade de France
  • catering services provided on the Stade de France site during events taking place therein.

5.2 PURCHASE OF TICKETS TO EVENTS TAKING PLACE AT THE STADE DE FRANCE, ACCESS PASSES FOR THE STADE DE FRANCE CAR PARKS FOR EVENTS TAKING PLACE THEREIN AND TICKETS FOR VISITS TO THE STADE DE FRANCE

5.2.1 Conditions of ticket purchase

5.2.1.1 Outright purchase conditions

Tickets to events

Tickets to the various events can be bought using the shopping cart.

The ticket management module automatically allocates the best available seats in the selected category.

The tickets to events can be:

- a single ticket for a seat or standing room depending on the selected category

- a Siège Premier (sitting) category ticket coupled with catering services delivered in a reserved area, hereinafter referred to as "Siège Premier Découverte". This catering service is described on the Website. It is provided under the conditions stipulated in Articles 5.3.1 and 5.3.2 below.

Access passes for the Stade de France car parks for the events

Access passes for the various events can be purchased with the shopping cart.

The price of the access pass is given "inclusive of all taxes" and includes rental costs.

Tickets for visits to Stade de France

Tickets for the various visits to the Stadium can be purchased using the shopping cart.

The price of the ticket is "inclusive of all taxes".

Note: The conditions of payment for outright purchases of tickets are described in Article 8 hereof.

5.2.1.2 Conditions of purchase on option of tickets to events and for the car parks

These specific conditions of purchase only apply to tickets for events and for the Stade de France car parks for the aforementioned events and must be paid for by cheque in accordance with the provisions stipulated in Article 8 below.

Once the "Demande d’option" (request option) section is proposed for an event, the CE User may request an option for this event before placing a firm order. The duration of the option varies depending on the events. This possibility is proposed by the "Demande d’option" section on which the CE User must click.

If there are many requests for an event, STADE DE FRANCE may reduce the duration of options or dictate that orders be directly placed without any option period.

The option is a pre-booking issued via the Website in the "Business, Groups & CE" space for an event open to sale and with known prices; the option concerns a given number of seats (more than or equal to 10) in one or more categories selected by the CE User. STADE DE FRANCE may restrict the number of seats requested depending on the quotas open for sale.

An option may be increased or decreased as long as the deadline date has not expired and within the limit of the available seats. The CE User may modify its option requests on the Website as long as they have not been processed by STADE DE FRANCE. In any case, the CE User will receive an option request modification confirmation email or a processing confirmation email as applicable.

The option is confirmed in writing by STADE DE FRANCE which allocates each CE User a file number and a deadline date for payment. The option shall be automatically cancelled should the CE User fail to pay under the conditions stipulated in Article 8, unless said User has made a written request to extend the deadline of the option.

An option only becomes an order upon receipt of payment for the total amount owed.

Orders are processed by STADE DE FRANCE according to the order of arrival within the limit of the available quotas.

The CE User may contact the STADE DE FRANCE Service Clients Grand Public (general public customers department) at +33 (0)1 55 93 01 49 (cost of a local call from a landline, possible additional costs depending on operator), from Monday to Friday from 9 a.m. to 12.30 p.m. and from 2 p.m. to 5.30 p.m. with regard to any questions relating to the follow-up of its order.

Note: The conditions of payment for ticket purchases on option are described in Article 8 hereof.

5.2.1.3 Conditions of purchase on option of group tickets for the visits

These conditions of purchase are reserved for the purchase of at least 20 group tickets for a visit to the Stade de France per order.

The CE User places an option for the visit of its choice. The duration of the option is set to 20 days.

If there are many requests for a day or a specific time, STADE DE France may have to reduce the duration of the options or require immediate confirmation without an option period.

An option may be increased or decreased as long as the deadline has not passed and subject to availability of the guides.

A guide may not take a group of more than thirty participants.

The option is confirmed in writing by STADE DE FRANCE which allocates each CE User a file number and a deadline date for payment. The option shall be automatically cancelled should the CE User fail to pay under the conditions stipulated in Article 8 and provided that said User has not made a written request to extend the deadline of the option.

Group cancellations shall be invoiced under the following conditions:

* less than 7 days before the scheduled date: 50% of the order.
* less than 48 hours before the scheduled date: 100% of the order.

If one or more participants cancel less than 8 days before the visit, the CE User shall be charged for the number of participants on the reservation sheet.

Orders are processed by STADE DE FRANCE depending on their order of arrival within the limit of the available quotas.

The CE User may contact the STADE DE FRANCE Service Clients Grand Public (general public customers department) at +33 (0)1 55 93 01 49 (cost of a local call from a landline, possible additional costs depending on operator), from Monday to Friday from 9 a.m. to 12.30 p.m. and from 2 p.m. to 5.30 p.m. with regard to any questions relating to the follow-up of its order.

5.2.2 Ticket dispatch conditions

All tickets purchased by a CE User on the Website, whether paid for by cheque or bank card, are sent by DHL courier service and delivered against signature at the risks of the CE User, subject to dispatch and management costs of 12 euros inclusive of tax for France and 25 Euros inclusive of tax for abroad, per order..

An invoice is enclosed with the tickets.

STADE DE FRANCE may not be held liable for the loss, theft or delay in dispatch of the tickets especially in the event of strike of the postal services and the related delays.

If it does not receive the tickets, the CE User shall contact the STADE DE FRANCE Service Clients Grand Public at +33 (0)1 55 93 01 49 (cost of a local call from a landline, possible additional costs depending on operator) in order to check the ticket dispatch conditions.

CE Users must check the order as soon as they receive the tickets. Any claim or complaint concerning the content of the order must be made by telephone and confirmed in writing to STADE DE FRANCE Service Clients Grand Public located at ZAC du Cornillon Nord 93216 SAINT DENIS LA PLAINE CEDEX, FRANCE, telephone: +33 (0)1 55 93 01 49 (cost of a local call from a landline, possible additional costs depending on operator), on the day the tickets are received.

5.2.3 Conditions for using the tickets at the events and at the Stade de France car parks

The purchase of tickets implies acceptance of the General Terms of Sale and Use of the tickets giving access to the Stade de France events specified on the ticket, the Organiser’s General Terms of Sale/Purchase and Use of the tickets and the Stade de France® corporate rules of procedure displayed at the entrances to the stadium. All these documents are available on the Website and/or upon simple written request to STADE DE FRANCE. Any person who does not comply with these conditions and regulations may be denied access to the Stade de France or may be evacuated without being able to claim compensation for his/her ticket.

In case of conflict between the STADE DE FRANCE General Terms and those of the Organiser, the Organiser's General Terms of Sale/Purchase and Use of the tickets shall prevail.

Within the context of managing the ticket office, Consortium Stade de France acts on behalf of the organiser.

The purchaser, whether the CE User or the transferee, of one or more tickets shall refrain from selling and/or offering said tickets for sale by any means (Internet, etc.). For reasons of safety, the purchaser of a ticket or tickets for sporting events may under no circumstances sell and/or transfer said ticket (tickets) to a third party who supports the opposing team, it being specified moreover that if tickets with names are issued they shall not be transferred.

Under penalty of legal proceedings, the holder of a ticket shall refrain from using it and/or trying to use it for any promotional, advertising or commercial purpose whatsoever in particular within the context of contests, lotteries, internal stimulation operations, auctions and/or associate its name in whatever way with that of Stade de France or the organisers/producers of the event. Should use of the ticket breach the aforementioned provisions without prior written authorisation of STADE DE FRANCE or of the organiser, said ticket shall no longer be valid and may be cancelled by STADE DE FRANCE at its sole discretion or at the request of the organiser and the holder of the ticket may be denied access to Stade de France without any repayment and/or compensation being owed to the holder or to any third party.

Tickets may not be returned or exchanged. No duplicate will be issued in the event of loss.

It is prohibited to photograph, film, record or rebroadcast by any means, in particular via the Internet, the event stated on the front of the ticket or to help any other person to perpetrate said actions. In order to protect the public, Stade de France® is equipped with a video surveillance system placed under the control of a police officer and which may be used in the event of criminal proceedings. A right of access is scheduled during the 7 days the images are kept. Moreover, spectators are warned that if a movie is being filmed or if the event is broadcast on the television, their image may appear therein.

Furthermore, holding a ticket implies irrevocable authorisation by the spectator of the use by the organiser and Consortium Stade de France, of his/her voice, image and representation by video recording or direct broadcasting, transmission or recording, photograph or any other medium existing to date or in the future, taken or recorded during said holder's presence at the Stade de France. These rights can be transferred by the organiser and Consortium Stade de France to any third party of their choosing, free of cost, worldwide and without any time limit.

With regard to shows or performances, if the performance must be interrupted during its second half, this ticket shall not be refunded. Furthermore, in the event of a cancellation, postponement, interruption, closed session, modification of the programme or distribution, any refund (excluding management, dispatch, transport and accommodation costs) shall be subject to the conditions of the organiser of the event.

In general, events shall take place under the sole liability of the organiser.

Any exit is permanent.

5.2.4 Conditions of use of tickets for visits to the Stade de France

These conditions apply to the purchase of tickets for visits to the Stade de France except for the purchase of group tickets as stipulated in Article 5.2.1.3.

A ticket to visit Stade de France is valid for one visit to made within a one-year period as from the date of issue of the ticket.

The CE User shall consult the calendar of visits to the Stade de France available on the Website or at the Stade de France Boutique ZAC du Cornillon Nord 93216 SAINT DENIS LA PLAINE, FRANCE.

STADE DE FRANCE may be obliged to cancel a visit due to the priority given to sporting and cultural events (including periods of availability of Stade de France to organisers), and/or for operating and/or safety reasons.

Tickets cannot be returned or exchanged. No duplicate will be issued in the event of loss.

5.3 PURCHASE OF CATERING SERVICES

As part of the sale of catering services alone, or catering services coupled with the Sièges Premier Découverte, STADE DE FRANCE purchases this service from its catering service provider EUREST SPORTS ET LOISIRS.

5.3.1 Conditions of purchase of catering services

The catering services which can be purchased on the Website are only delivered on the days of the events, in the locations stated on the voucher and for the event specified upon purchase.

Given that access to the Stade de France is only authorised to holders of a valid ticket, the CE User is reminded that it must hold a ticket for the event in order to benefit from the catering service purchased on the Website for the corresponding event.

Catering services can be purchased for different events through the shopping cart.

The price of the catering services is given "inclusive of tax".

STADE DE FRANCE undertakes to provide the catering services purchased on the Website only while the stocks of the products composing the catering service last.

Should the product be unavailable, STADE DE FRANCE agrees to inform the CE User by email or at the latest on the day scheduled for collection of the product at the Stade de France. STADE DE FRANCE may offer the CE User a substitute of equivalent quality and price. Accordingly, the CE User may, at its discretion, choose to accept the substitute offered or waive the product against reimbursement of the price paid upon purchase within thirty days at the latest following the request for reimbursement made by the CE User by registered letter with acknowledgement of receipt to the address stated in Article 7.

Note: The conditions of payment for catering services are described in Article 8 hereof.

5.3.2 Voucher dispatch conditions

STADE DE FRANCE shall issue a voucher for all catering services purchased by a CE User on the Website, alone or coupled with Sièges Premier Découverte, irrespective of whether they are paid for by cheque or bank card. The voucher shall be sent by DHL courier service and delivered against signature at the risks of the CE User, subject to dispatch and management costs of 12 euros inclusive of tax for France and 25 Euros inclusive of tax for abroad, per order.

All the conditions stipulated in Article 5.2.2 for the dispatch of tickets apply to the dispatch of vouchers.

The CE User shall present the voucher at the retrieval location indicated on said voucher in order to collect the purchased catering service.

The catering services coupled with Sièges Premier Découverte are delivered in a reserved area upon presentation of the voucher.

No refund or compensation shall be owed by STADE DE FRANCE if the CE User does not go to the retrieval location on the day of the event and at the time stated on the voucher to collect the catering service purchased. The CE User shall be fully charged for the catering service.

The conditions of use of the tickets stipulated in Article 5.2.3 fully apply to the voucher.

ARTICLE 6 – PURCHASE OF MERCHANDISING PRODUCTS

6.1 MERCHANDISING PRODUCTS

The Website offers the following merchandising products for sale (non-exhaustive list):

  • tie-in merchandise for an event such as: scarves, caps, jerseys, balls, CDs, DVDs, etc.
  • "Stade de France" products
  • accessories, knickknacks, etc

6.2 CONDITIONS OF PURCHASE OF MERCHANDISING PRODUCTS

CE Users can purchase merchandising products on the Website from an online catalogue.

The online catalogue is composed of two separate sections:
- one presenting the merchandising products sold by third parties
- the other presenting the merchandising products sold by STADE DE FRANCE but purchased from third parties.

The CE User shall be automatically directed to the third party website in order to purchase a product sold by a third party. With regards to products purchased from a third party, only the latter's general conditions shall apply to the transaction performed between the CE User and the third party. Within this context and notwithstanding Article 10 hereof, STADE DE FRANCE may not be held liable for the processing of transactions thus performed with third parties, their fulfilment and the resulting consequences.

The merchandising products that can be purchased on the Website shall only be made available to the CE User on the days of the events in the Stade de France boutiques designated during purchase and at the times stipulated on the voucher for the event specified during purchase.

On the days of the events, as access to the Stade de France is only authorised to holders of a valid ticket, the CE User is reminded that it must hold a ticket for the event in order to be able to retrieve the merchandising product purchased on the Website for the corresponding event.

Merchandising products for different events can be purchased using the shopping cart. Only products related to the event that will be taking place at the Stade de France on a given day can be collected during said event.

The price of merchandising products is "inclusive of all taxes".

Should the product be unavailable upon collection, STADE DE FRANCE agrees to inform the CE User by email or at the latest on the day scheduled for collection of the product at the Stade de France. STADE DE FRANCE may offer the CE User a substitute of equivalent quality and price. Accordingly, the CE User may, at its discretion, choose to accept the substitute offered or to waive the product against reimbursement of the price paid for its purchase within thirty days at the latest following the request for reimbursement sent by the CE User by registered letter with acknowledgment or receipt to the address stated in Article 7.

Merchandising products may not be returned or exchanged.

Note: The conditions of payment of merchandising products are described in Article 8 hereof.

6.3 VOUCHER DISPATCH AND USE CONDITIONS

STADE DE FRANCE shall issue a voucher for all merchandising products purchased by a CE User on the Website, whether said products are paid for by cheque or bank card. The voucher shall be sent by DHL courier service and delivered against a signature at the risks of said CE User, subject to the dispatch and management costs of 12 euros inclusive of tax for France and 25 Euros inclusive of tax for abroad, per order.

All the conditions stipulated in Article 5.2.2 for the dispatch of tickets apply to the dispatch of vouchers.

The CE User shall present the voucher in the Stade de France boutiques specified upon purchase and at the times stipulated on the voucher, in order to retrieve the purchased merchandising product.

No refund or compensation shall be owed by STADE DE FRANCE if the CE User does not go to the retrieval location on the day of the event and at the time stated on the voucher to collect the merchandising product purchased. The merchandising product shall be fully invoiced to the CE User.

The conditions of use of the ticket stipulated in Article 5.2.3 fully apply to the voucher

Should the CE User specifically wish to benefit from the dispatch of merchandising products, it shall contact the Stade de France Service Clients Grand Public (general public customers department) in order to determine the feasibility of this dispatch, its cost and the special applicable conditions.

6.4 LEGAL WARRANTY

In accordance with regulations, STADE DE FRANCE undertakes to fulfil its obligations relating to the warranties attached to the products sold on its Website, and which appear in the articles below extracted from the French Civil Code:

Civil Code, Article 1641:
A seller is bound to a warranty on account of the hidden defects of the things sold which render it unfit for the use for which it was intended or which so impair said use that the purchaser would not have acquired it or would only have given a lesser price for it had he been aware of them.

Civil Code, Article 1648:
The action resulting from latent defects must be brought by the purchaser within a period of two years following the discovery of the defect.

ARTICLE 7 - CLAIMS

Except in the case of legal warranty, any transaction between STADE DE FRANCE and the CE User that is not challenged within 6 months shall not give rise to a claim.

ARTICLE 8 – CONDITIONS OF PAYMENT FOR TICKETS, CATERING SERVICES AND MERCHANDISING PRODUCTS

8.1 PAYMENT AND VALIDATION

8.1.1 Payment and validation of outright purchases

The tickets purchased by outright purchase, catering services and merchandising products* (*merchandising products sold by STADE DE FRANCE on the Website) shall be paid for by bank card or by cheque.

 

Only the following cards are accepted for payment of online purchases: Carte bleue / Visa / Eurocard / Mastercard.

Bank card payments are protected by the SSL (Secure Socket Lysers) coding system by ATOS which encrypts and secures confidential information

The CE User's bank account shall be immediately debited of the amount in euros of the tickets, catering services and merchandising products all costs included.

For cheque payments, the CE User must promptly send a cheque made out to Consortium Stade de France, that can be cleared in France, to the following address: Service Pros, Groupes, et CE, Stade de France, ZAC du Cornillon Nord 93216 Saint Denis la Plaine Cedex, France. The tickets and vouchers shall only be sent after full payment of all monies owed.

Once the order has been validated, the sale becomes binding, subject to full.

A purchase cannot be modified or cancelled.

 

You must state your acceptance of these Terms of Sale and Use in their entirety prior to clicking on the "valider” (validate) button after you have finished making your purchases. The data recorded by STADE DE FRANCE constitutes the proof of all the transactions entered into by STADE DE FRANCE and its CE Users. The data recorded by the secure payment system is proof of the financial transactions.

In any case, the provision online of the bank card number and the final validation of the purchase shall constitute proof of the entirety of said purchase in accordance with the provisions of Act dated 13 March 2000 and will cause the sums incurred by the order to become due.

This validation shall constitute signature and express acceptance of all transactions carried out on the Website.

8.1.2 Payment of tickets on option

Tickets purchased on option shall only be paid for by cheque sent to the address stipulated in Article 7.

An option only becomes an order upon receipt of the payment corresponding to the total amount owed.

Orders are processed by STADE DE FRANCE according to their order of arrival within the limit of the available quotas.

The order shall be settled through a single payment for all tickets and vouchers by cheque made out to Consortium Stade de France and which can be cleared in France, before the tickets are dispatched.

8.2 INVOICING

Provided that the payment is accepted by the bank card authorisation centre, the CE User shall receive an invoice by email stating, among others, its order number.

If the bank card authorisation centre refuses the payment, the CE User shall receive an email cancelling the order and requesting that it renew its order in accordance with these Terms.

In the event of payment by cheque, the invoice corresponding to the purchases made by the CE User shall be enclosed with the tickets and vouchers sent by DHL.

If there is a problem such as for instance, the minimum or maximum quantity of tickets per event is not complied with, an inaccurate address or any other problem ascribable to the user, STADE DE FRANCE reserves the right to block the user's order until the problem is solved.

The CE User may consult the status of its order at any time by connecting to its personal space on the Website, "Consulter mes commandes" (consult my orders) section.

8.3 ARCHIVING

The computerised registers kept in the STADE DE FRANCE IT systems under reasonably secure conditions shall be considered as proof of communications, orders and payments made.

Except for obvious error by STADE DE FRANCE, the data kept in the STADE DE FRANCE information system shall have evidential value with regard to orders placed by the CE User. The orders and invoices are archived on a reliable and permanent medium so as to correspond to an exact and lasting copy in accordance with Article 1348 of the French Civil Code.

ARTICLE 9 – PROMOTIONAL OFFERS

Promotional offers may be launched for the products. All special promotional offers shall be subject to these Terms. In the event of conflict between the terms of the special offer and these Terms, the terms of the special offer shall prevail.

STADE DE FRANCE reserves the right to modify the terms of the special offers or to remove them at any time. Any order placed before the offer is removed or modified shall be honoured under the conditions in force on the date of the order.

ARTICLE 10 – LIABILITY

STADE DE FRANCE shall be liable for proper fulfilment of the obligations resulting from the remote contract entered into whether said obligations are to be fulfilled by itself or by other service providers, without prejudice of its right to take action against said service providers.

However, STADE DE FRANCE may be exempted of all or part of its liability by providing proof that the failure to fulfil its obligations or the improper fulfilment of the obligations under the contract is ascribable to the CE User or to the unforeseeable and unavoidable act of a third party to the contract or a case of Force Majeure.

Likewise, STADE DE FRANCE shall not be held liable for any drawback or damage inherent to use of the Internet network such as a service outage, an external intrusion or the presence of a computer virus.

The CE User acknowledges that it is fully informed of the unreliability of the Internet network in particular in terms of non-guarantee of access, absence of security relating to the transmission of data and non-guarantee of performance relating to the transmission of data.

The CE User shall refrain from any fraudulent, abusive or excessive use of the Website which is strictly restricted to private usage.

Consequently, STADE DE FRANCE cannot guarantee and may not be held liable for malfunctions or failures occurring on the STADE DE FRANCE servers and which are not due to its own fault as well as malfunctions or failures occurring on networks connected to its own network.

ARTICLE 11 – PERSONAL DATA

The Website is designed to be attentive to the needs of CE Users. It is for this reason among others that STADE DE FRANCE uses cookies. The cookie signals that the CE User has been on the Website. Accordingly, cookies are only used by STADE DE FRANCE with the objective of improving the personalised service dedicated to CE Users.

The CE User can receive its invoices through the email address provided to STADE DE FRANCE. Depending on the choices made during creation or consultation of its account, the CE User may receive STADE DE FRANCE offers and offers from other subsidiary companies or commercial partners, by email, telephone or SMS as specified upon creation of the account.

In accordance with Article 32 of Act No.2004-801 dated 6 August 2004 relating to the protection of physical persons with regard to processing of personal data and amending the Data Protection Act No.78-17 dated 6 January 1978, users have a right to access, modify and delete personal information that can be exercised at any time with STADE DE FRANCE,

ARTICLE 12 – INTELLECTUAL PROPERTY

Should the CE User wish to terminate its account on the Website, it shall send an email to the following address: contact@stadefrance.com and shall indicate in the subject line the following words "suppression de mon compte Pros, Groupes et CE" (deletion of my Business, Groups & CE account).

STADE DE FRANCE may close the CE User's account if it does not comply with these General Terms of Sale and Use.

ARTICLE 14 – SUSPENSION OR INTERRUPTION OF SERVICE

STADE DE FRANCE reserves the right to modify, interrupt or discontinue the Website at any time. It may not be held liable in this respect.

The CE User may be suspended from the Website should it breach the provisions of the General Terms of Use, these Terms or the applicable regulation. Moreover, STADE DE FRANCE shall be authorised to suspend the Website to perform any levelling or preventive maintenance operations or to extend the network.

ARTICLE 15 – LINKS TO OTHER WEBSITES

The Website may contain links to other websites. Should the CE User decide to access said links, it shall do so at its own risk.

STADE DE FRANCE shall not be held liable for the content of said other websites or their availability; the CE User accepts that STADE DE FRANCE may not be held liable for losses and injuries that it may suffer due to connecting to said websites.

ARTICLE 16 – DISPUTES

These Terms are governed by French Law. Any dispute arising from the construction and/or execution hereof shall, as far as possible, be settled by means of amicable negotiations. Failing an amicable settlement, all disputes shall be brought before the qualified Courts.
