Terms of Use for Stade de France Wi-Fi

GENERAL TERMS AND CONDITIONS OF USE FOR WIFI AT THE STADE DE FRANCE

The purpose of this document is to define the terms and conditions of use of the Wi-Fi internet connection service available in the areas covered within the Stade de France. Visitors to the Stade de France (hereinafter referred to as ‘Visitors’) using the Wi-Fi service provided free of charge by the Société d'Exploitation du Stade De France - SESDF (hereinafter referred to as ‘the Service’) are required to comply with the following provisions, in particular the French Data Protection Act of 6 January 1978 (hereinafter referred to as the ‘Data Protection Act’), the violation of which is punishable by criminal penalties.

SESDF reserves the right to adapt or modify these General Terms and Conditions of Use at any time. Visitors are therefore invited to consult the General Terms and Conditions of Use regularly in order to keep abreast of the latest developments.

To use the Service, Visitors must open a web page within the Stade de France and accept these General Terms and Conditions of Use by ticking the corresponding box and then confirming.

VISITOR OBLIGATIONS

1. When visiting the Stade de France, Visitors undertake not to use the Service to transmit, record, broadcast and/or reproduce, on any medium and by any means, in whole or in part, any sounds, images or content protected by intellectual property rights, including, but not limited to, descriptions, results, photographs and videos relating to any events taking place at the Stade de France.

In general, Visitors shall refrain from sending, transmitting and receiving via the Service, by any means whatsoever, any data or content that is prohibited, illicit, illegal, contrary to public decency or public order, including, but not limited to, content of a paedophilic or pornographic nature, inciting racial hatred or the commission of xenophobic, anti-Semitic, sexist or sexual crimes and offences, or infringing on the image rights and privacy of others, or more generally on the rights of third parties.

The Visitor undertakes to strictly comply with these provisions and indemnifies SESDF against any claims or actions in this regard. Failure to do so will render the Visitor liable for all consequences of breaching these provisions, including any damages and compensation that may be owed to SESDF and any third parties.

2. The Visitor undertakes to use the Service in accordance with the rules of good conduct on the Internet.

In particular, the Visitor shall refrain from any fraudulent, abusive or excessive use of the Service, such as:

  • the deliberate or accidental overloading of email servers and/or email recipients through unsolicited bulk emailing (e.g. spamming) or the network;
  • the sending of attractive messages that necessarily generate a large number of responses, thereby disrupting the availability of servers or networks;
  • making available, downloading, viewing, sharing, exchanging or communicating in any way whatsoever, in particular by means of peer-to-peer software or streaming, works protected by the intellectual property rights of third parties;
  • piracy in any form, intrusion into computer or audiovisual systems, hacking, spreading viruses, Trojan horses or other programmes intended to cause harm in any form.

The SESDF also warns Visitors about the nature and diversity of content available on the Internet, which may be harmful to minors.

3. It is expressly stated that the Internet is not a secure network. Under these circumstances, it is the Visitor's responsibility to take all appropriate measures to protect their own data and/or software, in particular from contamination by any viruses circulating on the Internet or from intrusion by a third party into their equipment systems for any purpose whatsoever, and to make backups of their equipment before and after the Service is set up.

In this regard, the Visitor acknowledges that they have been fully informed:

  • the unreliability of the Internet network, particularly in terms of the lack of security relating to data transmission and the lack of guarantees regarding performance in terms of data volume and transmission speed;
  • that the integrity, authentication and confidentiality of information, files and data of any kind that they wish to exchange over the Internet cannot be guaranteed. Customers should therefore not send messages over the Internet if they wish to ensure that their confidentiality is guaranteed without fail.

4. All Visitors must refrain from collecting or misusing any personal information to which they have access and, in general, from any action that could infringe on the privacy or reputation of others.

5. Visitors are solely responsible for any direct or indirect, material or immaterial damage caused to third parties as a result of their use of the Service.

OBLIGATIONS OF THE SESDF

SESDF is subject to an obligation of means with regard to the operation of the Service.

It endeavours to operate and maintain the Service accessible but is not bound by any obligation of result. Visitors are informed that SESDF reserves the right to suspend access to the Service at its discretion, in particular for maintenance or hacking reasons, without Visitors being able to make any claim or dispute in this regard.

In addition, SESDF reserves the right to limit the duration or speed of internet connection via the Service per day and per device (mobile phone, computer, tablet, etc.).

SESDF is not liable for any physical, material or immaterial damage, whether consequential or not, caused to the Visitor as a result of their use of the Service.

PERSONAL DATA

Dans le cadre de l’accès au Service, la SESDF collecte les données techniques de connexion suivantes : adresse IP et adresse MAC (ci-après « les Données »)

Les Données sont conservées pendant 1 an à compter de leur enregistrement.

La base légale du traitement est le respect d’une obligation légale (article L39.3 du Code des postes et des communications électroniques).

Les Données sont uniquement accessibles au service interne de la SESDF et aux autorités judiciaires en cas de demande.

Le Visiteur peut accéder aux données le concernant et exercer son droit à la portabilité. 

Pour exercer ces droits ou pour toute question sur le traitement des Données, le Visiteur peut contacter le délégué à la protection des données : Société d’Exploitation du Stade de France - DPO - Zac du Cornillon Nord 93218 La Plaine Saint Denis Cedex ou dpo@stadefrance.com.

Si le Visiteur estime, après avoir contacté le DPO de la SESDF, que ses droits « Informatique et Libertés » ne sont pas respectés, il peut adresser une réclamation à la CNIL https://www.cnil.fr/fr.

APPLICABLE LAW

These Terms and Conditions of Use are subject to French law.

In the event that the Visitor uses the Service at the Stade de France as a professional, any dispute relating to the interpretation, validity and/or execution of these Terms and Conditions of Use shall be submitted to the competent French courts.

Concession

Gestionnaire exploitant
